1. Purpose
These terms govern the use of the Holivaya website, published by MEREJI (see the legal notice). By browsing the site, you accept them.
2. What Holivaya is
Holivaya is an information guide that highlights places to stay with a heated pool, based on information found online or provided by the properties themselves. Holivaya is neither a travel agency nor a booking intermediary: it sells no stays, takes no payments and is not a party to any contract between you and a property. Every booking is made directly with the property or the booking platform you choose, under their own terms.
3. Source and limits of the information
The information published (pool heating and heating period, water temperature, facilities, ratings, reviews, location, etc.) comes from public sources — official property websites, booking platforms, press, guest reviews paraphrased and cross-checked where available — or is declared by the properties. Holivaya checks it carefully but cannot guarantee that it is accurate, complete or up to date at the time of your stay: a property may change its facilities, opening hours or heating period, close its pool for works or suffer a breakdown. Ratings and review counts are those shown on the platforms cited, at the date indicated.
4. Responsibility for heating and services
Heating, temperature, opening and proper functioning of the pool are the sole responsibility of the property, as are all services, prices, availability and cancellation terms. Holivaya cannot be held liable if, during your stay, the pool is not heated, does not reach the advertised temperature, is closed or unavailable, nor for any resulting damage, cost or inconvenience. Before booking, we recommend that you ask the property to confirm in writing that the pool will be heated on your dates, and to what temperature.
5. External links and affiliation
The site contains links to third-party websites (properties, booking platforms, sources). Holivaya has no control over these sites and is not responsible for their content or practices. Some links are affiliate links: Holivaya may earn a commission on a booking at no extra cost to you.
6. Partner listings
Listings in the “Partner listings” section are written from information provided by the owners, who guarantee its accuracy and are responsible for it; they may be subject to a paid subscription. Holivaya may refuse, edit or remove a listing at any time.
7. Report an error
Found inaccurate information, or are you the property concerned and want a correction or removal? Write to contact@holivaya.com and we will correct it as soon as possible.
8. Availability
Holivaya endeavours to keep the site available but cannot guarantee it at all times; it may be interrupted for maintenance or in case of failure.
9. Intellectual property and personal data
The site’s content is protected: substantial reproduction without permission is prohibited. The processing of personal data is described in the legal notice.
10. Changes and governing law
These terms may be changed at any time; the applicable version is the one online at the time of your visit. They are governed by French law. Subject to mandatory consumer protection rules, any dispute falls under the jurisdiction of the competent courts of Lille, France.
